Please read our Terms of Booking carefully. Definition of terms referred to in the conditions below:

The word “owner” refers to the legal property owner of the villa.
The word “rate” refers to the charge for the rental period that the clients have agreed and paid for.
The word “villa” refers to Villa 101, Carretera De Cala Tarida, Sant Josep de sa Talaia, 07830 Ibiza. A 6 bedroom, 5 bathroom (1 WC) house in nearly 7000 sqm of its own private land.
The word “client” refers to the individuals within the rental party group that has rented the villa.
The words “lead client” refers to one of the clients that they have appointed to represent all of the client’s communication and interests during their stay at the villa.
The words “arrival date” refers to the first day of the commencement of the short term rental period.

The words “check in” refers to the time when the “clients” rental contract commences and they must look around the villa and confirm they accept the villa and note any breakages that they see at the check in. The term “rental period” refers to the term that “clients” have rented the villa for, usually 1 week, Saturday to Saturday, unless otherwise arranged.
The term “breakages” refers to damage to fixtures and fittings that did not exist prior to the arrival date.
The term “Check out” refers to the ending of the “rental period” and the process by which the “clients” must check the villa and its contents with the owner or his agent to confirm breakages and replacement fees.
The term “cancellation” refers to the situation when the clients inform the owner or his agent that they do no longer wish to rent the villa on the days and times they originally had requested.

BOOKING PAYMENT TERMS

1) To reserve the rental period the client must:a) Send a scanned copy of his passport to the owner
b) Send a signed scanned rental contract to the owner
c) Send a rental deposit equal to 50% of the agreed total rent paid by bank transfer to the owner’s nominated account in the agreed currency. The client must send an email with proof of bank transfer to the owner and or his selected agent. The email will secure the rental period until funds have cleared, usually within 3 working days.Without proof of transfer there will be no guarantee of a reservation. On receipt by the owner of the advance payment this sum will be deducted from the total rental fee for the agreed rental period.Both the rental deposit and balance of rent are non-refundable once funds have been received by the owner or his agent subject to the terms and conditions of the booking.

2) The balance of the rent due (50% of the agreed total rent) and the security deposit of 3500 Euros must be paid by bank transfer no later than 60 days prior to the start of the rental period. If the funds are not received at least 60 days prior to the start of the rental period the booking will be deemed to have been cancelled by the client. Both rental deposit and balance of rent are non-refundable once funds have been received by the owner.

3) Payment details & contract to provided by the owner.

4) The owner is unable to provide VAT receipts.

BOOKING CANCELLATION & AMENDMENT TERMS

5) If the booking is cancelled within the 60 days prior to the start of the rental period the security deposit will be returned.

6) If, after the booking is confirmed, the client wishes to amend the booking the owner will try to accommodate any changes, but it may not be possible or desirable for the owner in which case the cancellation terms would apply.

EXCLUSIONS & LIABILITY

7) The owner is not responsible for any loss, breach or delay beyond their reasonable control, including though not limited to act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by-laws, or measures of any kind on the part of governmental or local authority, strikes, lockouts, or other industrialactions or disputes or adverse weather conditions.

8) The Owner assumes no responsibility for injuries or death to persons renting and/or other guests on the premises of the rental property. Children must be supervised at all times, especially around the swimming pools.

9) The owner assumes no responsibility for the client’s valuables. The client is advised to purchase travel insurance to protect them and their valuables.

10) No pets allowed on the rental property without written permission from the owner prior to the rental period.

11) Fire risk is a serious matter in Ibiza. Due to risks of forest fire local law forbids outside barbecue and lighting of candles.

12) Villa 101 is a non smoking villa. Cigarettes are not permitted to be used inside the villa. Outside of the villa please dispose of used cigarettes and be very careful of soft external furnishings.

13) The owner is responsible for the breakdown of mechanical equipment, such as pumps, boiler, swimming pool filtration systems etc. In case of breakdown the client must notify owner and or his agent immediately to allow them to take all reasonable actions to repair. Neither the agent nor the owner are responsible for the failure of public utilities such as water, gas, electricity, or for any water wells feeding the property. The owner is also not responsible for noise and disturbance originating beyond the boundaries of the rental property.

14) The rental period is for the specified number of persons. Any additional person occupying the rental property could result in loss of security deposit. Only the amount of people mentioned above are accepted as part of rental group. Violation of this will be seen as breach of contract and can lead to forfeiture of security deposit.

15) Cleaning. Daily cleaning service is not included in the rental rate. However, it is available at an additional rate. We do not permit bath towels or linens to be taken from the property. Access to dishwasher and pay washing service but no washing machine.

16) While all the photographs and all descriptions of the rental property are fundamentally correct, the owner cannot accept responsibility if minor errors or differences in the photographs/illustrations/text used and the actual property arise. The Owner has the right to make modifications to the property specifications that are considered necessary in the light of his operating requirements. In the interest of the continued operation of the villa the owner also has the right to alter furniture, fittings amenities, facilities, or any activities, either advertised or previously available, without prior notice.

17) Social events and other functions (e.g. weddings, receptions and large cocktail parties), are not allowed without prior agreement. Permission will be required for any event where more than twice the number of people being accommodated in the rental property are attending. Where permission is granted, an additional fee may be charged. Violation of this will be seen as breach of contract and can lead to forfeiture of security deposit and immediate departure from the rental property without compensation.

18) Clients are prohibited from landing or attempting to land any commercial or private aircraft at the house and its grounds. Any attempt will be deemed that the clients breach of contract.

19) The client must not noise pollute the local environment. Ibiza imposes fines of up to 10,000 euros for serious noise pollution. The client is asked to respect neighbors during their rental period. Any and all fines incurred by the client during his stay must be paid prior to departure.

MAINTENANCE SCHEDULES
AND NOTICE

20) Where ever possible the owner and or his agent will provide at least one hour’s notice via telephone to the client and agree any visit to the property with the client prior to their arrival at the villa.In any case, the owner and or his agent reserves the right to inspect his property without warning during the term of the rental period.

INVENTORY CHECK IN &
CHECK OUT. DAMAGE UTILITIES

21) The inventory check will be made of the rental property by owner and or his agent on the day of the arrival and will be repeated at the inventory check out on the day of departure.

22) Meter readings for electricity and water are taken as a part of the check in and check out procedure. A large credit of 200 euros is included as a part of the rental agreement which would normally cover water and electricity needs for a large group of 12 people’s stay at the villa for approximately 2 weeks summer use. This credit is non-refundable.

Where water and or electricity used by the client exceeds this 200 euro credit the additional costs will be charged to the client via a deduction from the security deposit.

23) Included in the rental: pool service, garden service & barbecue.
